Season Race Planner ("Service") is operated by Susanne Lier ("we", "us", "Seller"), trading as Paddlefit. By using the Service you enter into an agreement with the Seller. Contact: susanne@paddlefit.ch.
By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are of legal age and, if acting for an organisation, have authority to bind it.
Season Race Planner is a web application for endurance athletes and coaches to plan races, training and goals across a season. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
You must not misuse the Service. In particular, you must not: (a) use the Service for unlawful purposes, fraud or spam; (b) infringe intellectual property or other rights; (c) interfere with the Service's security or integrity, including by introducing malware, probing, scanning or scraping; (d) reverse engineer, resell or redistribute the Service; or (e) circumvent technical limits or access controls. You are responsible for activity under your account and for keeping your credentials confidential.
You retain ownership of the training data, race plans and other content you submit. You grant us a limited licence to host and process that content solely to provide the Service to you (including sharing with a coach where you have explicitly enabled that).
The Service, including its software, design, documentation and branding, is owned by the Seller and protected by intellectual property laws. No rights are granted to you except as expressly set out in these Terms.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, applicable taxes, subscription renewal, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy.
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
To the extent permitted by law, our aggregate liability for any claim arising out of or in connection with the Service is capped at the fees you paid in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as fraud, death or personal injury caused by negligence).
We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious violations of these Terms. On termination, your right to use the Service ends; you may request export of your data within a reasonable period before deletion.
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
These Terms are governed by the laws of Switzerland. Disputes are subject to the exclusive jurisdiction of the competent courts of Switzerland, unless mandatory consumer law provides otherwise.
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
